Most possession penalties in MO are considered a Class C Felony, which has a maximum penalty of 7 years in jail, and a $5000 fine.
Marijuana possession of less than 35 grams is a Class A Misdemeanor, punishable by up to a year in jail and a fine of $1000.
In a drug possession case, the state must prove beyond a reasonable doubt that a) what they found was an illegal substance, and b) that it belonged to you. You have a right against unreasonable search and seizure. In many drug possession cases, I'll file a motion to suppress any evidence against you if that evidence may have been illegally obtained. There are a variety of other rights and protections that you have under the US Constitution, and Missouri laws. Drug Possession / Possession of controlled substance penalties
Possession of any controlled substance (unless it is 35 grams or less of marijuana) is considered a Class C Felony under Missouri possession laws.
Possession of 35 grams or less of marijuana is a Class A Misdemeanor under Missouri possession laws.
Under Missouri drug laws, substances classified as Schedule I are considered to have a "high potential for abuse", and "no accepted medical use" or "lacks accepted safety for use in treatment under medical supervision" (Missouri Drug Regulations, Ch 195, Section 17). Examples of schedule I drugs include heroin & marijuana.
Substances classified as Schedule II are also considered to have a "high potential for abuse", but and also "has currently accepted medical use in treatment" and, "abuse of the substance may lead to severe psychic or physical dependence" (Missouri Drug Regulations, Ch 195, Section 17). Examples of schedule II drugs include cocaine, amphetamines, & meth.
